1. Introduction
Welcome to NeutralResourceHarbor ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at neutralresourceharbor.sbs (the "Service") operated by NeutralResourceHarbor.
By reserving a yacht or using our Service, you consent to these Terms. Should you not agree with any section of these terms, then you are not permitted to use the Service.
2. Service Overview
NeutralResourceHarbor offers a range of exclusive yacht charter services, including the following:
- One-day yacht hire
- Evening boat rides
- Business retreats
- Custom events
- Long-duration charters
Availability of services is contingent on various factors. We maintain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Have reached the age of majority, typically 18 years
- Supply truthful and complete details
- Make an initial deposit as outlined in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is only secured once payment is received and we provide written confirmation. We reserve the right to deny service to anyone at our sole discretion.
3.3 Availability
Bookings are subject to the availability of vessels and appropriate weather conditions. We shall strive to fulfill your preferred dates and timings when possible.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and comprise all relevant taxes unless stated otherwise. Pricing is susceptible to change without notification.
4.2 Payment Schedule
- Initial Deposit: Half of the total cost of the charter, due upon booking
- Remaining Balance: Required 48 hours prior to the charter's commencement
- Extra charges, if applicable: Payable after the charter concludes
4.3 Payment Methods
We accept a variety of payment methods, including major credit cards, bank wires, and certified checks. Payment processing is done using secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund minus transaction fees
- Between 24 to 72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
Should the captain deem weather conditions unsafe, we will suggest to:
- Reschedule your charter for another suitable date at no extra charge
- Issue a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there is a mechanical failure with the designated vessel, we will make an effort to supply a comparable alternative. Where an alternative cannot be offered, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are obliged to:
- Obey all directions from the crew
- Utilize safety gear when mandated
- Disclose any health conditions that might impact their safety
- Remain within designated areas on the yacht
6.2 Prohibited Items
The following items are not allowed on the yacht:
- Glass objects
- Illegal substances
- Weapons of any kind
- Pets (except with special permission)
6.3 Conduct
Guests are expected to behave respectfully. Should passenger conduct endanger safety or disrupt others' experience, we may terminate the charter prematurely without reimbursement.
7. Liability and Insurance
7.1 Our Liability
Our liability is capped at the cost you have paid for your charter. We are not accountable for:
- Injuries incurred due to passenger misjudgment
- The loss or harm to personal belongings
- Any form of indirect or punitive damages
- Delays due to weather or situations outside our control
7.2 Insurance Coverage
We carry full marine insurance covering our fleet and operations. Passengers need to have their own personal and travel insurance in place.
7.3 Assumption of Risk
Engaging in our yacht services implies that you recognize the inherent dangers of maritime activities and take full responsibility for your personal safety and risks.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, travel routes, or schedules owing to weather, safety considerations or operational needs. We will endeavor to offer comparable alternative arrangements.
9. Force Majeure
We shall bear no liability for interruptions, cancellations, or alterations prompted by events beyond our sway, including but not confined to:
- Severe meteorological conditions
- Natural calamities
- Regulative edicts
- Port closures
- Mechanical failures
10. Privacy and Data Protection
Your personal data is managed in accordance with our Privacy Policy. By using our services, you permit the collection and use of your data as detailed in our Privacy Policy.
11. Intellectual Property
All content on our site, including text, graphics, and logos, is shielded by copyright and trademark regulations. Unauthorized reproduction, distribution, or derivative work creation is strictly prohibited without our explicit consent.
12. Governing Law
These Terms are subject to the laws of Monaco. Disputes shall be adjudicated in the courts of Monte Carlo, Monaco.
13. Changes to Terms
We reserve the prerogative to amend these Terms at our discretion. Any alterations will be published on our website with the new revision date noted. Continuation of service usage implies agreement to any revised terms.
